Sasikala cannot be shifted to Chennai prison, find out why

AIADMK General Secretary Sasikala’s lawyers are keeping no stone un-turned in their efforts to find a legal way to shift her to the Chennai jail. The lawyers also said that they had commenced the process of efforts to shift Sasikala as per the provision of law.

Speaking to Times of India, advocate BV Acharya has said that Sasikala cannot be shifted from Parappana Agrahara by the consent of officials. Speaking about the jail manual, he said that officials of the two prisons (Karnataka and Chennai in Sasikala’s case) decide among themselves and come to a conclusion if the convict should be shifted. But as Sasikala was convicted by the Supreme Court, this provision is not applicable for Sasikala.

He also said that Sasikala cannot be shifted without the apex court’s permission. Even if she is shifted, under some provision, this can be challenged in the court. According to rules, Sasikala is considering to move Supreme Court with review petition. The petition has to be filed within 30 days.

Sources said that Sasikala’s counsel had said that the lawyers were planning to apply either to the jail superintendent or the Karnataka Law Minister. There is a bleak chance that she will get a green signal to shift from Karnataka Law Minister as the state has been strongly pursuing the case for over a decade.

However, it was also said, Sasikala’s counsels had stated that she was put up in Parappana Agrahara, with just a wall separating her from Cyanide Mallika, country’s first woman serial killer; and also that there were tensions between Tamil Nadu and Karnataka regarding Cauvery River water sharing as some of the reasons to shift her to Chennai.

Back in Tamil Nadu with her proxy Palanisamy winning the floor test and deputy general secretary Dinakaran (who is also her nephew) meeting Sasikala in the jail to discuss the matters of the state is a clear indication that she is all set to rule the state from the prison.

Getting shifted to Chennai might be a plan to make her have control over the happenings of the state. But going by the legal expertise, her desire might remain a dream.
